Collaborative Divorce

In Alabama, the Collaborative Divorce process starts with an agreement between the spouses that they intend to resolve issues of the divorce as amicably as possible through cooperation and negotiation. This process allows the divorcing spouses the opportunity communicate effectively to resolve issues such as property division, child custody and support through a less adversarial process. This is wonderful opportunity for parties to dissolve the marriage with as little drama as possible.

Should the parties be unable to resolve issues in the divorce through collaberation, they still have the option to go to Court and proceed with adversarial proceedings. However, they will need to obtain new counsel.

Active duty service members experiencing separation may be required to provide support even before the filing of divorce with a civilian court. This is called Financial Support and refers to the amount that you may be required to pay to your dependents following a separation.

The amount of Financial Support varies by branch, but is generally set by your command as opposed to a civilian court order. Failure to follow Financial Support orders can result in major financial and employment burdens on the Service Member, as well as punishment under the UCMJ.

Active Duty members require competent and knowledgeable representation familiar with the special circumstances surrounding Military Financial support.
